The agreement between you and us when you use Tougather: what it does, what you may use it for, and who is responsible for what.

who we are

These terms are the agreement between you and the provider of Tougather (“we”, “us”) for the Tougather website and the tool at /app/. By using the tool you accept them. If you use Tougather for a company, you accept them on its behalf.

Tougather is offered by Goudbeek, a sole proprietorship (eenmanszaak).

what tougather is

Tougather is a web tool where you build a team of AI agents for your business, give them your knowledge and tools, and ask them for work in a chat or by voice. Agents research, write, calculate and prepare drafts, and can use services you connect.

You can also plan tasks in an agenda: once, on repeat, or after another task. Their results wait for you in Review. Posts you approve can be published to your social channels through Publish.

We keep improving Tougather, so features may be added, changed or removed.

your account

  • You sign in with a Google or Microsoft account. Each workspace has one owner, who can invite others and give them a role.
  • Tougather is made for businesses and professionals. You must be at least 16 to use it.
  • Keep access to your Google or Microsoft account secure. What happens in your workspace under your sign-in is your responsibility.

you stay in charge

Tougather is built so that you decide what your agents may do:

  • You choose which tools and connected services each agent may use, and every tool call shows on screen.
  • In a chat, an agent can use the tools you gave it, including actions in services you connected. Give each agent only what it needs.
  • A planned task only reads and prepares drafts by default: it can't send or pay through your connectors unless you turn on “May send or pay” for that task. Its result waits in Review, where you approve it, redo it with a note, or open the conversation.
  • Only posts a person has approved are published, at the moment that person chose. Agents have no tool to publish. Editing a post after approval makes it a draft again.

You are responsible for what you approve, send and publish, and for what happens in the accounts you connect.

AI output can be wrong

Answers, drafts and summaries come from AI models. They can be incorrect, incomplete or out of date, and can sound sure while being wrong. The calculation tools compute amounts exactly, but only from the numbers they are given.

Check what an agent makes before you rely on it or pass it on, especially anything legal, financial, medical, or sent to customers. Output from Tougather is not professional advice.

acceptable use

Don't use Tougather to:

  • break the law, or help someone else break it;
  • infringe someone's intellectual property, privacy or other rights;
  • send spam or messages people didn't ask for;
  • make people believe they're talking to a person when the law requires you to say it's AI;
  • create content that is illegal, hateful, harassing, deceptive or sexually exploits anyone;
  • process sensitive personal data of others (such as health data) without a legal basis;
  • attack, probe or overload the service, get around its limits, or try to reach another workspace;
  • resell access to Tougather without our written agreement.

The usage policies of the AI model providers and of the services you connect apply as well.

your content

What you add to Tougather, and what your agents make for you, is yours, as far as the law allows. You give us permission to store, process and send it only as needed to provide Tougather to you: for example to the AI model provider that answers a request, or to a service you connected. Make sure you have the right to use what you add.

The Tougather software, website and name are ours. While these terms apply, you may use the tool for your own business; you may not copy or resell it.

processing on your behalf

When your agents handle personal data of others for your business, such as messages from your customers through the website chat, email or WhatsApp, you decide why and how; by default, a reply in a channel is a draft that waits for you in Needs you. You are the controller and we are your processor under article 28 of the GDPR. This section is our data processing agreement with you; it applies automatically and needs no signature.

  • Only on your instructions. We process that data only to provide Tougather to you, as you set it up, and never for our own purposes or to train models.
  • Confidential. Only we have access, and only when needed to keep Tougather running or when you ask for help.
  • Secured. The measures are in how we protect it.
  • Subprocessors. The services we use are listed under who we share it with, with the AI providers in AI models and your data. You agree we use them. We tell you in advance about a new one, and you may object; if we can't resolve it, you can end your use.
  • Your obligations to others. You can export and delete the data yourself (Settings → your data). We help with requests from the people concerned and with a data protection impact assessment where that's reasonable.
  • Breaches. If a breach involves your data, we tell you without undue delay, with what we know, so you can meet your own duty to report.
  • At the end. When you delete a workspace or your use ends, we delete the data, except what the law requires us to keep.
  • Checks. On request, we give you the information you need to show this agreement is kept.

other services

Tougather works with services run by others: AI model providers, the services you connect, Google and Microsoft for signing in, and Upload-Post for publishing. Their own terms apply to how you use them. We're not responsible for those services, and they may change or stop what they offer.

plans, limits and payment

  • The plans and their prices are on the pricing page. Each plan has a maximum number of agents.
  • There is no online payment in the tool yet. A paid plan is arranged on request, through the form on the pricing page; we confirm the price and terms with you before you pay anything.
  • Each workspace has a daily budget for AI model use. At the limit, depending on your settings, the cheapest model that can handle each question takes over, you confirm each new question first, or the agents stop. Past a hard ceiling they stop until the next day. You can set a lower limit, not a higher one than ours.
  • To keep Tougather working for everyone, there are limits on how often some actions can be done, and we may limit use that goes far beyond what is normal for your plan.

availability and changes

We work to keep Tougather running, but we can't promise it's always available or free of errors. Maintenance, a provider that is down, or a problem on our side can interrupt it. Keep your own copy of anything you can't do without.

If we change Tougather in a way that takes away something important from a paid plan, we'll tell you in advance.

ending

You can stop using Tougather whenever you want. The owner can download everything in a workspace and delete it under Settings → your data; you can also ask us (see who we are).

We may suspend or close your access if you seriously or repeatedly break these terms, if the law requires it, or to prevent harm to others or to the service. Where that's reasonable, we'll warn you first. When your account is closed, we delete your workspace and account data, except what the law requires us to keep.

liability

Tougather is provided as it is. As far as the law allows, we're not liable for indirect damage, lost profit or lost data, or for damage from AI output you relied on or from actions you approved or allowed. Our total liability is limited to what you paid us for Tougather in the 12 months before the damage occurred.

None of this limits liability for intent or gross negligence, or rights that the law doesn't allow us to limit, such as your rights as a consumer.

law and disputes

Dutch law applies to these terms. Disputes go to the competent court in the Netherlands. If you're a consumer, you keep the protection of the mandatory law of the country where you live. Please contact us first: most things are easier to sort out together.

changes to these terms

We may change these terms, for example when Tougather changes. We update the date at the top, and for important changes we'll let you know in advance. If you don't agree with a change, you can stop using Tougather and ask us to delete your account.
